assault and criminal defense for southern connecticut

If you've been charged with assault in Connecticut, you're likely facing social, financial, and legal consequences from these allegations. It's a difficult time that's often filled with heightened emotion, and making a successful case requires extensive knowledge of the complicated workings of the state's legal system. Luckily, Attorney Paz is experienced, persistent, and passionate about defending your rights in the face of these charges.

How Does Connecticut Define Assault?

In order to be charged with assault in Connecticut, you must have:

Intentionally caused someone else to fear imminent physical injury, or

Intentionally caused someone else physical harm.

This can be done through either direct contact or the use of a deadly weapon. The state also recognizes three different types of assault: first-degree, second-degree, and third-degree. These distinctions are made as follows:

First-degree assault is the most serious charge and is typically charged when a weapon is used that causes serious physical injury.

Second-degree assault is usually charged when there was an attempted use of a deadly weapon or someone was recklessly endangered.

Third-degree assault is the least serious charge and is typically charged when there is any allegation of physical contact which results in any type of physical injury or pain.

What Are The Penalties For Assault In Connecticut?

The penalties for assault in Connecticut will depend on the type of assault a person is charged with as well as the severity of the victim's injuries. First-degree assault is a felony charge that is punishable by up to 20 years in prison (in some circumstances, carrying a 5-year mandatory minimum) and a fine of up to $15,000. Second-degree assault is also a felony charge and is punishable by up to 5 years in prison and a fine of up to $5,000. Third-degree assault is a misdemeanor charge and is punishable by up to 1 year in prison and a fine of up to $2,000.

Possible Defenses To Assault Charges

There are several possible defenses to assault charges in Connecticut, and the best defense will depend on the individual circumstances of your case. A few possible defenses might include:

Self-defense. You may be able to claim self-defense if you can show that you reasonably believed that you or someone else was in imminent danger of harm and that the use of force was necessary to prevent that harm.

Lack of intent. You can only be convicted of assault if the prosecution can prove that you had the intention to cause fear or harm. If they cannot do this, then you cannot be convicted of assault.

False accusation. You may be the victim of a false accusation, and if there is insufficient evidence to prove your guilt beyond a reasonable doubt, then you cannot be convicted of assault.

Of course, these are only a few of the possible arguments that might apply to your case. In order to determine your best defense, we’ll need to consult with you on the facts surrounding your situation.
